Citation Protection – Terms & Conditions

These Terms & Conditions (“Terms”) govern membership in ATDSA’s Citation Protection service (“Service”). By enrolling, paying dues, or using the Service, you (“Member,” “you”) agree to these Terms.

1. What the Service Is (and Isn’t)

  • Citation Protection is a membership program that helps Members obtain access to legal assistance for eligible traffic citations through a vetted network of independent attorneys and legal service providers. ATDSA is not a law firm and does not provide legal advice.
  • No guarantee of outcome. Neither ATDSA nor any attorney guarantees dismissal, reduction, or any particular outcome.
  • Court costs/fees are the responsibility of the member unless otherwise stated in writing.

2. Relationship to Insurer/Administrator

If certain administrative or defense-cost benefits are insured or administered by [Delta Plans, Inc.], those insured/administrative components are subject to the policy/certificate terms, which control in the event of conflict. This membership is not insurance unless explicitly stated otherwise.

3. Eligibility & Enrollment

You must provide accurate, current information. Misrepresentation or fraud may result in denial or termination of benefits or membership. Coverage begins upon acceptance and payment or the effective date listed in your confirmation.

4. Covered Matters (Scope)

Subject to these Terms and any plan schedule: Representation/assistance is available on eligible non-criminal traffic infractions issued within the U.S., where permitted. We match Members with an attorney or provide instructions for engaging one; the attorney determines legal strategy and required appearances.

5. Exclusions & Limitations

The Service does not cover felonies, DUIs/DWIs, hit-and-run, reckless driving with injury, pre-existing citations, failures to appear, appeals, accidents, or matters outside covered jurisdictions, unless expressly stated.

6. Attorney Engagement & Control of Defense

Any attorney you retain is independent and represents you, not ATDSA. Engagement and legal strategy are between you and the attorney.

7. Member Responsibilities

You must cooperate, provide documentation, attend hearings if required, and meet deadlines. You are responsible for all court fines, costs, bonds, travel, and non-covered fees.

8. Fees, Billing & Refunds

Membership dues are payable as shown at checkout or in your schedule. They are non-refundable once attorney work begins, except where required by law.

9. No Unauthorized Practice of Law

ATDSA is not a law firm and does not give legal advice. Communications with ATDSA staff are not privileged.

10. No Insurance/No Indemnity

Except for any explicit insured components administered by [Delta Plans, Inc.], this membership does not insure you against fines, penalties, or damages.

11. Compliance & Fraud

Submitting false or misleading information may result in denial/termination and may be referred to authorities.

12. Disclaimers; Limitation of Liability

To the maximum extent permitted by law, ATDSA’s liability to you is limited to the membership dues paid for the twelve (12) months preceding the event. ATDSA is not liable for indirect, incidental, or consequential damages.

13. Dispute Resolution; Class-Action Waiver

Any dispute between you and ATDSA will be resolved by binding arbitration on an individual basis. You waive any right to participate in a class or collective proceeding.

14. Term, Renewal & Termination

Membership terms and renewal policies are stated at checkout or in your schedule. We may terminate for nonpayment, fraud, abuse, or violation of these Terms.

  • Security: We use reasonable administrative, technical, and physical safeguards to protect your data.
  • Your Rights: You may request access, correction, or deletion of your personal data as required by law.
  • Retention: We retain data as needed to provide services and comply with legal obligations.

16. Changes to the Program or Terms

We may update these Terms or program features prospectively. Material changes will be posted with a new effective date and provided as required by law.

17. Governing Law; Venue

These Terms are governed by Illinois law. Venue for disputes not subject to arbitration is Lake County, Illinois.

18. Entire Agreement; Severability

These Terms, your membership schedule, and any applicable policy/certificate constitute the entire agreement. If any provision is unenforceable, the remainder remains in effect.
